In order to implement China’s foreign investment law and its implementing regulations, to encourage and guide foreign investors to invest in specific industries, sectors and regions, the National Development and Reform Commission and the Ministry of Commerce have amended the Catalogue of Encouraged Industries for Foreign Investment (2022 Version) and released the Catalogue of Encouraged Industries for Foreign Investment (Draft for Comments) (the “Catalogue”) to solicit public comments.

The Catalogue consists of two parts, i.e., the national catalogue of encouraged industries for foreign investment and the catalogue of priority industries for foreign investment in central and western China. In the draft Catalogue, the encouraged investment items in the sectors of new energy and energy conservation and environmental protection are increased, especially new energy vehicles, wind energy and solar energy. In addition, certain expansions and adjustments are made in relation to digital economy, agriculture and agricultural product processing, biopharmaceuticals and health industries, culture and tourism, health and elderly care, etc. The deadline for comments on the draft Catalogue was January 20, 2025.
